
Married parents have equal rights and stand on equal footing during a divorce or dissolution.
Under Ohio Law, an unmarried woman is the sole legal custodian and residential parent of a child until a court deems otherwise. Consequently, a father must file an Application to Determine custody in Juvenile Court in order to assert his rights. Once the Application is filed, both parents are equal in the eyes of the court.
